Apex Rent-to-Own Terms & Conditions

1. Overview

The Apex Rent-to-Own (“RTO”) Program offered by Apex Gaming PCs, Inc. (“Apex,” “we,” “our,” or “us”) allows customers (“you,” “your,” or “lessee”) to acquire ownership of a new Apex Gaming PC through affordable monthly payments over a defined 12-month term.
Participation in this program constitutes acceptance of these Terms & Conditions in full.


2. Program Structure & Pricing

All Apex R-Series PCs (R1X, R2X, R3X, and R4X) are priced based on the product’s MSRP plus a 10% financing fee and 7% simple interest.
This formula ensures flat, transparent pricing for all customers, regardless of credit score.

  • No hidden fees.

  • No compounding interest.

  • No variable APRs.

Your total monthly payment is clearly displayed before checkout and reflects the total cost of ownership divided by the chosen term.


3. First Payment, Fees, and Application Policy

  • Applied, Not Lost: The first month’s payment is non-refundable, but always applied to your order — to your rent-to-own balance if you proceed, or to the application fee if you choose not to continue.

  • Waived Application Fee: The application fee is waived if you proceed with the order and applies only if you do not continue.

  • Application Fee Coverage: If charged, the application fee covers:

    • Soft-pull credit report (no impact on credit score)

    • Underwriting and eligibility review

    • Identity verification

    • Payment method verification and fraud prevention

  • Down Payment: Some applicants may be required to provide a down payment of up to 30% of the rent-to-own value depending on creditworthiness.

    • FICO ≥ 650: No down payment required.

    • FICO < 650: Down payment may apply and can be made gradually before shipment with no penalties or added fees.


4. Approval, Verification & Lead Times

All R-Series applications are subject to:

  • Identity and payment verification

  • Document and underwriting review

Approval of your application does not guarantee shipment. Apex reserves the right to decline or cancel any order prior to shipment for any reason, including but not limited to:

  • Fraud prevention

  • Incomplete or unverifiable information

  • Failed payment authorization

  • Excessive prior chargebacks or non-payment behavior

Lead Times

R-Series systems generally ship 2–3 weeks after the Rent-to-Own Agreement is signed, following successful verification.
The verification and approval process may take up to 2 weeks, resulting in a total lead time of approximately 4–5 weeks.


5. Ownership Terms

  • Ownership Transfer: You obtain full ownership of your PC once all scheduled payments have been successfully completed.

  • Early Payoff Option: You may pay your balance in full at any time without penalty and immediately receive ownership rights.

  • No Collateral: You do not need to provide collateral to participate.

  • Default: Failure to complete payments within the agreed term may result in collection action and loss of eligibility for future Apex R-Series purchases.


6. Fair-Use & Limited Program Availability

To ensure the program remains accessible to those who need it most:

  • Apex limits participation to 25 Rent-to-Own systems per month.

  • Applicants are encouraged to choose R-Series plans only if full upfront payment or traditional financing is not an option.

  • Misrepresentation of need or multiple concurrent R-Series agreements may result in cancellation or denial of future eligibility.


7. Shipping, Returns, and Cancellations

  • Cancellations: Orders may be canceled before shipment if requested in writing. Once the PC has shipped, standard Apex warranty terms apply and cancellations are not permitted.

  • Returns: Rent-to-Own purchases are final sale and cannot be returned for a refund.

  • Shipping: Shipping times vary based on verification and production. Customers are responsible for providing accurate shipping information.

  • Damaged Shipments: Any shipping damage must be reported to Apex within 72 hours of delivery.


8. Warranty Coverage

All Rent-to-Own systems include Apex’s standard limited hardware warranty, covering parts and labor for manufacturer defects during the warranty period.
Warranty coverage does not extend to accidental or user-caused damage. For full details, see the Apex Warranty Policy.


9. Late Payments and Non-Payment

  • Payments not received within 7 days of the due date may incur a late processing charge of up to $25.

  • Failure to make payments may result in collection activity, suspension of future R-Series eligibility, or referral to a third-party collections agency.

  • Apex reserves the right to disable future warranty or service support for accounts in default until payment is resolved.


10. Privacy & Data Security

All personal information submitted through the Rent-to-Own program is handled in accordance with our [Privacy Policy].
Credit data and identity verification results are securely processed through PCI-compliant providers and never stored in full by Apex.


11. Dispute Resolution

In the event of any dispute arising from participation in this program:

  • Both parties agree to attempt good-faith resolution prior to any formal action.

  • Disputes will be governed under the laws of the State of Texas and resolved through binding arbitration in Harris County, Texas.


12. Modifications & Termination

Apex may update or modify this Rent-to-Own Program at any time, including pricing adjustments, eligibility changes, or lead-time updates.
Existing customers will be notified of any changes affecting their active agreement.
