Apex Access Program – Terms & Conditions
1. Overview
The Apex Access Program (“Access Program”) offered by Apex Gaming PCs, Inc. (“Apex,” “we,” “our,” or “us”) allows customers (“you,” “your,” or “participant”) to obtain ownership of a new Apex Gaming PC through fixed monthly payments over a 6-month access term.
Enrollment in the Apex Access Program constitutes full acceptance of these Terms & Conditions.
2. Program Structure & Pricing
All Apex R-Series systems (R1X, R2X, R3X, R4X, R5X, and R6X) are priced based on the product’s MSRP plus access-related and administrative costs calculated over the 6-month term (these fees average 14.4% of the PC's cash price).
Access pricing adjustments may apply based on credit profile:

Up to 7% higher than standard pricing for credit scores below 620

Up to 7% lower than standard pricing for credit scores above 620
This pricing model ensures:

Transparent, flat pricing
-
No hidden fees
-
No compounding interest
-
No variable APRs
Your total monthly payment is disclosed before signing the Apex Access Agreement and reflects the total cost of ownership divided evenly across the 6-month term.
If you are determined to need an up to 7% increase on your monthly payment due to your credit score below 620, if you make three payments on time in a row, we will remove this premium.
Furthermore, if you make all six payments on time, we will refund 50% of your final payment to you!
3. First Payment, Fees & Application Policy
Applied, Not Lost
The first month’s payment is fully refundable and is either:

Applied toward your Apex Access system if you proceed, or
-
Refunded in full to your original payment method if you do not proceed
There is no application fee to participate in the Apex Access Program.
4. Approval, Verification & Lead Times
All Apex Access applications are subject to:

Identity verification

Payment method verification
-
Underwriting and document review
Approval does not guarantee shipment. Apex reserves the right to cancel or decline any order prior to shipment for reasons including, but not limited to:

Fraud prevention
-
Incomplete or unverifiable information
-
Failed payment authorization
-
Excessive prior chargebacks or non-payment history
Lead Times

Verification and approval may take up to 2 weeks

Systems typically ship 2–3 weeks after the Apex Access Agreement is signed

Estimated total lead time: 4–5 weeks
5. Ownership Terms

Ownership Transfer: Full ownership transfers upon completion of all scheduled payments

Early Payoff: You may pay off the remaining balance at any time with no penalty and immediately obtain ownership
Failure to complete payments within the agreed 6-month term may result in collection activity and loss of eligibility for future Apex Access or R-Series programs.
6. Fair-Use & Program Availability
To ensure long-term sustainability:

The Apex Access Program is intended for customers without access to upfront payment or traditional financing
-
Purchasing outright or using 0% APR financing is always the most cost-effective option
-
The average Apex Access fee is approximately 14.4%
Misrepresentation, abuse, or multiple concurrent Apex Access agreements may result in cancellation or permanent program ineligibility.
7. Shipping, Returns & Cancellations
Returns
All Apex Access systems may be returned at any time prior to the 6th payment being made. Need to pause at any point during the term? No problem.
Shipping
Customers are responsible for providing accurate shipping information. Delivery timelines vary based on verification and production schedules.
Shipping Damage
Any shipping-related damage must be reported to Apex within 72 hours of delivery.
7.2: Reinstatement Rights & Order Hibernation
7.2.1 Right of Reinstatement: In the event a Customer is unable to maintain the monthly payment schedule for an R-Series device, the Customer may elect to enter "Order Hibernation." Upon the voluntary return of the hardware to Apex Gaming PCs, we will hold the Customer’s account status and cumulative payment progress ("Equity") for a period of up to 180 calendar days from the date of receipt at our facility.
7.2.2 Reinstatement Process: Within the 180-day hibernation period, the Customer may reinstate their original Rent-to-Own agreement by paying any applicable reinstatement fees and resuming the remaining monthly payment schedule. Apex Gaming PCs guarantees that the Customer will receive either their original hardware or a unit of equal or superior specifications upon reinstatement.
7.2.3 Capped Shipping Responsibility: The Customer is responsible for logistics costs associated with the hibernation process. To ensure fairness and transparency, these costs are strictly capped:

Return Shipping: Capped at $42.50.

Re-delivery Shipping: Capped at $42.50.

Total Round-Trip Cap: The total logistics cost for the hibernation and reinstatement process shall not exceed $85.00 USD. Apex Gaming PCs will provide pre-paid, insured shipping labels to the Customer and deduct/bill these costs according to the reinstatement agreement.
8. Warranty Coverage
All Apex Access systems include Apex’s standard limited hardware warranty covering parts and labor for manufacturer defects during the applicable warranty period.
The warranty does not cover accidental damage, misuse, or user-caused damage. Full details are available in the Apex Warranty Policy.
9. Late Payments & Non-Payment
Late or missed payments may result in:

Collection activity
-
Suspension of future Apex Access or R-Series eligibility
-
Referral to a third-party collections agency
Apex reserves the right to suspend warranty or service support on accounts in default until payment issues are resolved.
10. Privacy & Data Security
All personal data submitted through the Apex Access Program is handled in accordance with Apex’s Privacy Policy.
Credit and identity verification data is processed through PCI-compliant providers and is never stored in full by Apex.
Your data remains your sole property. Apex Gaming PCs will never sell your personal information or retain it beyond the scope of your application.
In the event of a return, we will perform a secure data wipe to remove any personal information from the device. For your own peace of mind, we strongly encourage all customers to back up and delete their personal data before shipping the PC back to us.
11. Dispute Resolution
In the event of a dispute:

Both parties agree to attempt a good-faith resolution first

Unresolved disputes are governed by the laws of the State of Texas
-
Disputes shall be resolved through binding arbitration in Harris County, Texas
12. Modifications & Termination
Apex reserves the right to modify or terminate the Apex Access Program at any time, including changes to pricing, eligibility, or lead times.
Active participants will be notified of any changes affecting their existing agreement.
