Our liability is further limited by your failure to adhere to safety protocols as outlined in Section 22.

Because some jurisdictions do not allow certain limitations, in such areas liability will be limited to the maximum extent permitted by law.

SECTION 14 – INDEMNIFICATION

You agree to indemnify and hold harmless Apex Gaming PCs, its affiliates, employees, and suppliers from any third-party claim arising from your breach of these Terms or violation of law.

Fire & Hazard Disclaimer:  The Customer acknowledges that electronic components generate significant heat and require active cooling. Apex is not liable for any fire, smoke, or property damage resulting from:

  • Ignition of Accumulated Debris: Failure to keep the internal chassis free of dust, pet hair, or flammable debris.

  • Ventilation Blockage: Placing the unit on carpet, inside unventilated cabinetry, or against soft surfaces (curtains/bedding).

  • Electrical Overload: Failure to use a high-quality surge protector or plugging the unit into faulty household wiring.

  • Unattended Operation: Operating a known-malfunctioning unit (e.g., grinding fans or burning smells) without immediate disconnection.

Customer agrees to indemnify and hold Apex Gaming PCs Inc harmless from any claims, damages, or expenses arising from the improper or negligent maintenance of the hardware provided.

SECTION 15 – SEVERABILITY

If any provision of these Terms is held unenforceable, the remainder will still apply to the fullest extent possible.

SECTION 16 – TERMINATION

These Terms are effective until terminated by either you or us. We may terminate immediately if you fail to comply with these Terms.

SECTION 17 – ENTIRE AGREEMENT

These Terms, along with incorporated policies (including our Warranty & RMA Policy), constitute the entire agreement between you and Apex Gaming PCs.

SECTION 18 – GOVERNING LAW

These Terms of Service and any disputes shall be governed by and construed under the laws of the State of Texas, without regard to conflict of law rules. Venue shall be exclusively in Harris County, Texas.

SECTION 19 – BINDING ARBITRATION & CLASS ACTION WAIVER

Any dispute arising out of or relating to these Terms, the purchase of products, or your use of Services shall be resolved by binding arbitration under the rules of the American Arbitration Association. You waive the right to participate in any class action or class-wide arbitration. Each party will bear its own costs unless otherwise required by law.

SECTION 20 – FORCE MAJEURE

Apex Gaming PCs shall not be liable for delays or failure in performance caused by events beyond its reasonable control, including but not limited to supply chain disruptions, shipping carrier delays, natural disasters, labor disputes, acts of government, or internet outages.

SECTION 21 – WARRANTY & RMA POLICY INCORPORATION

All purchases are also governed by the Apex Gaming PCs Warranty & RMA Policy, which is incorporated by reference into these Terms of Service. By purchasing, you acknowledge and agree to the Warranty & RMA Policy as posted on our website at the time of your purchase.

REVISED SECTION 22 – ADHERENCE TO SAFETY AND MAINTENANCE GUIDELINES

By using our Services and purchasing our products, you acknowledge that Apex Gaming PCs (DBA Manik) provides comprehensive Official Safety and Maintenance Guidelines. These guidelines are made readily available to all users through our website, Quick Start Guides, and official correspondence.

22.1 Universal No-Open Policy & Electrocution Risk
You acknowledge that all Power Supply Units (PSUs) and AIO liquid coolers are closed-unit systems with no user-serviceable parts inside. Opening the casing or unscrewing internal components presents a severe risk of electrocution and only should be used indoors. Any attempt to open the unit constitutes "improper use" and voids all warranties.

22.2 Hardware Identification & Cable Safety
You agree to use only the included cables specifically labeled for your PSU. Using incorrect or third-party cables presents a risk of catastrophic failure. In instances where a physical specification label or sticker is missing or obscured, you agree to verify model and cable compatibility via your digital invoice or Apex Support before installation.

22.3 Intended Use & Environment
Strict adherence to environmental protocols is required for system stability and fire prevention:

Surface Safety: You must never place or operate the unit on high-pile carpet, as this blocks critical intake and airflow.

Thermal Proximity: You shall not place the unit directly above or adjacent to heat-producing items (e.g., radiators, space heaters).

Mounting: It is recommended to install the power supply with the fan facing down, unless the case lacks bottom ventilation.

Assumption of Risk and Waiver of Liability: You agree that strict adherence to these guidelines is a condition of your use of the product. To the extent permitted by law, Apex Gaming PCs Inc DBA Manik makes no warranties, express or implied, regarding results obtained from improper use. 

If the user is a minor, a parent or guardian must read and understand the obligations and safety terms before the product is installed or used.

SECTION 23 – CORPORATE ENTITY AND BRANDING DISCLOSURE

Apex Gaming PCs Inc. is a corporation formed in the state of Pennsylvania. Please be advised that:

  • Doing Business As: Apex Gaming PCs Inc. officially operates under the registered fictitious name Manik.

  • Scope: All terms, conditions, and safety requirements outlined in this agreement apply equally to products branded as "Apex," "Apex Gaming PCs," or "Manik".

  • Headquarters: The principal place of business for all associated brands is 15700 Export Plaza Drive, Houston, TX 77032.

SECTION 24 – ADHERENCE TO SAFETY AND MAINTENANCE GUIDELINES

By using our Services and purchasing our products, you acknowledge that Apex Gaming PCs (DBA Manik) provides comprehensive Official Safety and Maintenance Guidelines. These guidelines are made readily available through multiple channels, including:

  • Web Documentation: Official documentation provided on our [Contact Us] and [Official Safety Guidelines] pages.

  • Physical Documentation: Our Quick Start Guide, Manuals, and Quick Start Guide QR Code included with product shipments.

  • Support Correspondence: Standard signatures and direct advice from our Support Team via customer emails (Support@ApexGamingPCs.com).

  • 22.1 Specific Hardware Prohibitions (Manik & Apex)

    • PSU High-Voltage Warning: Power Supply Units contain high-voltage internal components.

    • No Disassembly: You are strictly prohibited from attempting to disassemble or repair any PSU, AIO Liquid Cooler, or sealed electronic component.

    • Professional Support: Customers must contact support for all power-related or hardware inquiries.

  • Waiver of Right: Failure to follow the Official Safety and Maintenance Guidelines constitutes a waiver of your right to bring any legal action, including but not limited to lawsuits or claims of negligence, against Apex Gaming PCs Inc. (DBA Manik) for damages, personal injury, or property loss resulting from such failure.
  • Indemnification: To the maximum extent permitted by law, you agree to indemnify and hold harmless Apex Gaming PCs from any claims arising from your disregard of provided safety protocols.
