Apex Rent-to-Own Terms & Conditions

1. Overview

The Apex Rent-to-Own (“RTO”) Program offered by Apex Gaming PCs, Inc. (“Apex,” “we,” “our,” or “us”) allows customers (“you,” “your,” or “lessee”) to obtain ownership of a new Apex Gaming PC through fixed monthly payments over a 6-month term.

Enrollment in the RTO Program constitutes full acceptance of these Terms & Conditions.

2. Program Structure & Pricing

All Apex R-Series systems (R1X, R2X, R3X, and R4X) are priced based on the product’s MSRP plus a financing fee and an administrative fee calculated over the 6-month term. Financing fees may be up to 15% higher than standard for credit scores below 620.

This pricing model ensures:

Transparent, flat pricing
No hidden fees
No compounding interest
No variable APRs

Your total monthly payment is clearly displayed prior to checkout and reflects the total cost of ownership divided evenly across the 6-month term.

3. First Payment, Fees & Application Policy

Applied, Not Lost
The first month’s payment is fully refundable, and is either applied to your new Apex rent to own PC, or fully refunded back to your payment method. We do not charge an application fee.

4. Approval, Verification & Lead Times

All R-Series applications are subject to:

Identity verification
Payment method verification
Underwriting and document review

Approval does not guarantee shipment. Apex reserves the right to cancel or decline any order prior to shipment for reasons including, but not limited to:

Fraud prevention
Incomplete or unverifiable information
Failed payment authorization
Excessive prior chargebacks or non-payment history

Lead Times

Verification and approval may take up to 2 weeks
Systems typically ship 2–3 weeks after the Rent-to-Own Agreement is signed
Total estimated lead time: 4–5 weeks

5. Ownership Terms

Ownership Transfer: Full ownership transfers once all scheduled payments are completed
Early Payoff: You may pay off the remaining balance at any time with no penalty and immediately obtain ownership
No Collateral Required

Failure to complete payments within the agreed 6-month term may result in collection activity and loss of eligibility for future Apex R-Series programs.

6. Fair-Use & Program Availability

To ensure program sustainability:

The program is intended for customers without access to upfront payment or traditional financing. Buying outright or with 0% APR is always recommended.
Misrepresentation, abuse, or multiple concurrent R-Series agreements may result in cancellation or permanent ineligibility

7. Shipping, Returns & Cancellations

Cancellations
Orders may be canceled in writing prior to shipment. Once shipped, cancellations are not permitted.

Returns
All Rent-to-Own purchases are final sale and not eligible for returns or refunds.

Shipping
Customers are responsible for providing accurate shipping information. Delivery timelines vary based on verification and production.

Shipping Damage
Any shipping-related damage must be reported to Apex within 72 hours of delivery.

8. Warranty Coverage

All Rent-to-Own systems include Apex’s standard limited hardware warranty covering parts and labor for manufacturer defects during the warranty period.

The warranty does not cover accidental damage, misuse, or user-caused damage. Full details are available in the Apex Warranty Policy.

9. Late Payments & Non-Payment

Payments more than 7 days past due may incur a late processing charge of up to $25
Non-payment may result in:
- Collection activity
- Suspension of future R-Series eligibility
- Referral to a third-party collections agency

Apex reserves the right to suspend warranty or service support on accounts in default until payment issues are resolved.

10. Privacy & Data Security

All personal data submitted through the Rent-to-Own Program is handled in accordance with Apex’s Privacy Policy.

Credit and identity verification data is processed through PCI-compliant providers and is never stored in full by Apex.

11. Dispute Resolution

In the event of a dispute:

Both parties agree to attempt good-faith resolution first
Any unresolved disputes will be governed by the laws of the State of Texas
Disputes shall be resolved through binding arbitration in Harris County, Texas

12. Modifications & Termination

Apex reserves the right to modify or terminate the Rent-to-Own Program at any time, including changes to pricing, eligibility, or lead times.

Active customers will be notified of any changes affecting their existing agreement.
